Committee Terms of Reference

Headteacher’s Performance Management Committee

Membership

  • The membership of the committee will be at least 2 governors appointed by the Governing Body plus the SIP.
  • The Governing Body or the committee will appoint the person who is to chair this committee.
  • Staff and associate governors are disqualified from this committee.

Quorum

  • At least two members of the committee must be present and both must be governors.

Terms of Reference

  • Arrange to meet with the School Improvement Partner (SIP) to discuss the Headteacher’s performance management and review in accordance with current regulations;
  • To decide, with the support of the SIP, whether targets have been met and set new targets annually;
  • Monitor throughout the year the performance of the Headteacher against the targets;
  • Make written recommendations to the pay review committee in respect of pay progression for the successful meeting of targets set.

Pay Review Committee

Membership

  • The membership of the committee will consist of 3 governors appointed by the Governing Body plus the Headteacher.
  • The Governing Body or the committee will appoint the person who is to chair this committee.
  • Staff and associate governors will not be appointed to this committee.
  • Headteacher will not be in attendance for Headteacher pay review.

Quorum

  • At least three members of the committee must be present and all must be governors.

Terms of reference

  • Undertake decisions on recommended annual salary reviews for all staff (including Headteacher)
  • Advise Governing Body of decisions taken within the powers delegated by providing a statement of decisions taken – having regard to confidentiality
  • Assist in monitoring and keeping under review pay policy and make recommendations to Full Governing Body.
  • Assist in the determination of availability of funds for pay increments

Delegated Powers

Any delegated powers should be clearly stated and decisions taken reported back to the next governing body meeting, having due regard to matters that cannot be delegated to committees. (Approval of policies would be considered a delegated function)

Clerk to the committee

The Governing Body to appoint a Clerk to the Committee. This may be the Clerk of Governors or another clerk who is not a member of staff.

Pay review committee minutes are confidential; any report to other committees or the governing body would therefore also remain as confidential documents.

Pupil Admissions Committee

Membership

  • The membership of the committee will consist of 3 governors appointed by the Governing Body plus the Headteacher.
  • The Governing Body or the committee will appoint the person who is to chair this committee.
    Note: the Headteacher cannot chair this committee

Quorum

  • At least three members of the committee must be present and all must be governors

Functions of the committee

  • To draft and review the schools Admission Policy
  • To be responsible for the implementation of the policy
  • To report to the Governing Body as required

Delegated Powers

  • To consult as appropriate with other Admission Authorities on the schools admission policy
  • To draft the Admission Policy which the Governing Body must approve annually
  • When details of the applications are received from the Local Authority draw up an admissions lists indicating the order in which all applications have been ranked, priorities these by reference to the over subscription criteria
  • Forward the list to the co-ordination Local Authority

Clerk to the committee

The Governing Body must appoint a Clerk to the Committee. This may be the Clerk of Governors or another clerk.

The Headteacher is not allowed to act as clerk.

Appeals Committee

Membership

  • Membership is any three eligible governors from the whole Governing Body, as defined in ‘eligibility’ below.
  • The Governing Body or the committee will appoint the person who is to chair this committee.

Quorum

  • The quorum shall be three governors.

Terms of Reference

  • To consider and make decisions about matters referred to the committee relating to pupil admissions, parental complaints, pupil exclusions, staff dismissal appeals, staff pay appeals and staff grievances.
  • It will also consider any other matters referred to it which it can legitimately address.

Eligibility

To serve on the committee, governors must be ‘eligible’. Governors are eligible if they meet the following criteria

  • They have no detailed knowledge of the issue that is giving rise to the need to meet.
  • They have no connection with the appellant that could affect their objectivity.
  • They have not been involved with an earlier stage in the proceedings that led to the meeting.
  • They may not be a member of staff if the appraisal, competence or pay of any other member of staff is being discussed.
  • They may not be the Headteacher if dealing with a staff dismissal appeal, staff pay appeal, staff grievance, pupil exclusion, or complaint against the Headteacher.

The Headteacher must be present when dealing with matters relating to admissions.

Minutes and Proceedings

  • The minutes and proceedings of any meeting of the committee will be treated as confidential to the committee members alone.

Complaints Committee

Membership

  • At least 3 governors (not to include anyone with prior knowledge of the matter to be discussed)
  • The Committee will appoint the person who is to chair this committee

Quorum

  • Three eligible governors

Clerk

  • The minutes of the meeting will be professionally Clerked either by Clerk to governors or an external Clerk.

Terms of Reference

  • Act in accordance with School Governance Regulations and other legislation affecting the conduct and responsibilities of school governing bodies;
  • Consider complaints in accordance with the Schools agreed Complaints Procedure;
  • Advise the governing body of decisions taken within the powers delegated by providing feedback (minutes of meetings etc to remain confidential)

Disqualification

  • The Headteacher and any governor with prior knowledge of the matter to be discussed.

Pupil Discipline Committee

Membership:

  • 3 or 5 governors (excluding the Headteacher and any governor with prior knowledge of pupil or incident).
  • The Committee will appoint the person who is to chair this committee.

Quorum:

  • Three eligible governors

Clerk:

  • The minutes of the meeting will be professionally Clerked either by Clerk to governors or an external Clerk.

Terms of reference:

  • Operate within the statutory procedures relating to pupil exclusions, in particular to consider any representations about fixed term exclusions of between 5 and 15 days in one term.
  • Consider fixed term exclusions of more than 15 days in one term (including exclusions which in aggregate come to more than 15 days) and permanent exclusions.
  • Review the School Behaviour and Discipline Policy, and make recommendations on changes, to the governing body or relevant committee in light of decisions made.
